FACT FINDING REPORTA Hindu Community Young School Girl has been Escaped with Her Muslim Community Boy Friend to Get Marry

ALLEGED PERPETRATORS:
1) Md. Sekendar Ali (20) son of Md. Ramzan Ali @ Montu of Devipur,
2) Mohammad Selim Mondal (24) son of late Mozahar Ali of Devipur (Doulapara),
 3) Sree Kartik Chandra Sarkar (20) son of Sree Girindra Nath Sarkar@Babu of Moupukur,
4) Mohammad Ariful Islam (19) son of Md. Akbar Ali. (According to FIR but during the time of investigation the victim’s family members did not identify the name of the allege perpetrators except Md. Sekender Ali)

CASE SUMMERY:
Ms. Arpona Rani (17), a student of Debipur High School and also examinee of Secondary School Certificate (SSC) went to appear her SSC examination on March 14, 2010 around at 8.30 am to at Birampur Government High School centreand escaped with her beloved Md. Sekender Ali son of Md. Ramzan Ali @ Montu of Devipur along with her some other companion. On the way of the home Around at 2.00 pm Ms.Bidhu Bala, wife of late Karun Chandra Sarkar of Moupukuar, one of the aunt of the victim saw Ms Arpona Rani gossiping with Mr. Sekender Ali and other three young boys at Chandipur Moupukur Area. As soon as she reached at the house of the victim’s father, she informed them. Later Mr. Sachindra Nath Mondal along with his son Uttom Kumar , Niranjan Chandra Mondal, and his neighbour Kartik Chandra Mondal and Hitendra Nath Mondal of Moupukuar  in Birampur police station search the victim girl but fail to trace out.

Then Mr. Sachindra Nath Mondal, father of the victim with he help of local Union Parishad and Upazila Charman approached Md. Ramzan Ali, father of Mr. Sekender Ali and Md. Ramzan Ali assured him of the victim for rescue. But finally they failed to rescue the victim girl.

Thereafter, Mr. Sachindra Nath Mondal, father of the victim lodged a first information report (FIR) with Birampur Police station on 20 March 2010 that Birampur P.S. case No. 10 dated under section 7/30 of The Prevention of Women and Children Repression Act, 2000. Police recorded the case and arrested one alleged perpetrators Mohammad Selim Mondal (24) son of late Mozahar Ali of Devipur (Doulapara) on 21 April 2010. But they could not trace out the victim girl till 26th of April, 2010

BACKGROUND
Ms. Arpona Rani and Md. Sekender Ali read at same educational institution. Md. Sekender Ali was one class senior than Ms. Arpona Rani and also shemaintained a good relationship with the sister of Mr. Sekender. As a result of studing at the Debipur high School as well as good relation with both families, they are fall in love to each other. Finally, they escaped to get marry on the day of incident.

LEGAL STATUS:
Mr. Sachindra Nath Mondal, father and also legal guardian of the victim lodged first information report (FIR) at Birampur police station on 20th March,10 praying for recovery of her daughter against five perpetrators that No. Birampur P.S. case No. 10 dated 20.03.2010 under section 7[1]/30[2] of The Prevention of Women and Children Repression Act, 2000. Police recorded the case and arrested one alleged perpetrators Mohammad Selim Mondal (24) son of late Mozahar Ali of Devipur (Doulapara) on 21 April 2010. But they could not trace out the victim girl till 26th of April, 2010

ACTION:
BIHR fact finding team investigated the case from April 22 to 25, 2010. during the tie of investigation, BIHR’s team visited the spot, talked with the father, mother, brothers, aunts and other neighbors of the victims, talked with Investigation office (IO) of the case, Officer in Charge (O.C) of Birampur Police station, visited the office of Assistant Superintend of police Circle (ASP Circle), Fulbari Circle; Superintendent of Police (SP), Dinajpur and talked with them. The entire concerned police official assured BIHR team to trace out the victim as soon as possible (maximum seven days).

[1] If any person abducts any woman or child other than the purpose mentioned in section 5, he shall be punished with imprisonment for life or not less than 14 years and shall also be liable to fine.

[2] If any person abets by instigating or abetting another person to commit an offence punishable under his act and in consequence of abetent that offence is committed or is attempt to commit, the person so abetting shall be punished with the same punishment as is provided for the offence abetted.
