The State of Human Rights for the Month of July 2010

The Law enforcing agencies is still continuing the extra judicial killing, torture and harassment, though the government has come to power promising to promote and protect human right in Bangladesh

(The State of Human Rights for the Month of July 2010)

The Bangladesh Institute of Human Rights (BIHR) is a non-profit, non-governmental organisation registered with the Department of Social Welfare, Government of the Peoples Republic of Bangladesh based on the United Nation Declaration of Human Rights (UDHR) dedicated to promote and protect human rights in Bangladesh. BIHR publishes its state of Human Rights for the period of July 01 to July 31, 2010. The report was prepared by the research and documentation cell of BIHR on the basis of report published on 12 national news papers from July 02 to August 01, 2010, fact-finding mission and its direct sources. BIHR is resents and is deeply concerned over the continuing human rights violations in Bangladesh despite the promises to promote human rights, especially in regards to Extra-judicial Killing, torture, political violence, death due to negligence of doctor, rape, eve teasing and molestation, minority repression as well as violence against journalist and human rights defender. Adv. Shahanur Islam, the Secretary General of BIHR asks the Government to take prompt and effective measures ensuring and end to all kinds of violations as well as demands to investigate and bring the alleged perpetrations before the book, forming a special commission.

Human Rights Violation by State Party

Torture:

BIHR defines “torture” as the violation of human rights anywhere in Bangladesh by any means enacted by personnel of the law enforcing agencies. During the reporting period July 1st to 31th in 2010, 617 people were tortured several places in Bangladesh by law enforcing agencies. Most of them were labour of garment factory and 2 people severely injured by he shooting of policemen.

Death due to Killing:

During the reporting period, law enforcement agencies killed 17 people in different places in Bangladesh. Among them 9 people were killed by policemen, 5 were killed by Rapid Action Battalion (RAB), 2 people were killed by joint forces comprising the member of RAB and Policemen and 1 people was killed by Cost Guard. Among the incident 6 people were killed in the name of so called cross fire, 2 were killed in the name of gun fight, 7 were killed by torturing in police, and 2 were killed by shooting. Moreover, 2 people were fall in death due to run after by the police.

Death in Custody:

During the reporting period 7 people died in custody due to torture. During the period 3 prisoners were death in different jail in Bangladesh without torture.

Organized Violence

Death due to Political Violence:

During the reporting period 18 political leaders, activists and supporters were killed in different political parties in Bangladesh. Among them 12 were the leaders, activist and supporter of the ruling party in Bangladesh, the Awami league and its associated wings. Amongst them 3 were dead due to their internal conflict, 8 were killed by the terrorist and 1 was dead by Bangladesh Nationalist party (BNP) during the clash. Moreover, 6 were leaders, activist and supporters of Bangladesh Nationalist Party were killed in the same period, which of them 4 were killed by terrorist and 2 were dead by Bangladesh Awami League and its associate wings during the clash.

Injured due to Political Violence:

During the reporting period 575 political leaders, activists and supporters from different political parties in Bangladesh were injured. Among them 457 were the leaders, activists and supporters of the ruling party the Bangladesh Awami League and its associated wings, in which 378 of them were injured due to inner-party clashing and 59 were injured at the hand of the BNP and its associated wings and 37 people were injured by satra shibir and terrorists. Meanwhile, 72 leaders, activist and supporters of Bangladesh Nationalist Party (BNP) and its associated wings were injured, which of them 1o were injured due to inner-party clashes, 59 were injured at the hand of Bangladesh Awami League and its associate wings and 3 were injured by the hand of terrorist and others. Moreover, 47 people of others different party were injured by different clashes.

Minority Repression:

During the reporting period, 91 minority peoples were injured, 3 were abducted, 6 were murdered, 20pwoplw were compelled to leave their residing village due to 38 different incident of human rights violation including attacks, looting, vandalism, abduction, land grabbing, attempt to land grabbing, attempt to abduction, rubbery, destroying religious statue, treats and murder. These offenses have taken place against the ethnical and religious minority community in several area of Bangladesh. 

Mass Beating:

During the reporting period, 11 people were killed in different place due to mass beating and 21 were injured due to same reason.

Violence against Women and Children

Rape and attempt to Rape:        

During the reporting period a total 53 women, children and adolescent girl were raped. Among them 3 were killed by perpetrators after rape and 1 commited suicide after rape. All of them 16 were women and 37 were children and adolescent girls.  During the period 6 women and girl were victimized in gang rape and 1 was killed after gang rape.  Besides these incidents, 11 women and children were victimized in attempted rape.

Eve Teasing & Molestation:

The word molestation means, “sexual harassment through teasing, using abusive worlds, and unwanted disrobing. During the reporting period a total number of 67 women, adolescent girls and children, were victimized in eve teasing, molestation and sexual harassment in several places in Bangladesh.

Acid Throwing:
                                                     
During the reporting period 10 women, children and adolescent girl were victimized by acid throwing in several places in Bangladesh.

Violence Due to Dowry:

During the reporting period 18 house wives were killed and 14 were physically assaulted by their husbands or members of their husband’s family due to dowry and family related matters. Moreover, 1 was committed suicide due to dowry related violation.

Abduction and Trafficking:                                                                    

During the reporting period 145 people were abducted from different places in Bangladesh. Among them 7 were women and 26 were children and adolescent girls. Besides this, 5 women and girls were attempted abduction. Moreover 52 women, girls and children were rescued during the time of trafficking in difference place of the country.

Suicide and suspected death:

During the reporting period 42 people committed suicide in different places in Bangladesh. Among them 21 were women and 9 were children and adolescent girls. Moreover, 1 was attempted to commit suicide. Besides this, 24 were suspected death, which of them, 11 were women and 13 were others.

Other Social Violence

General Killing:

During the reporting period 248 people died due to different kinds of social violence in several place throughout Bangladesh. Among them 67 were women, 36 were children and adolescent girls and 145 were others.

Death due to Negligence and Dead Body Recovery: 

During the reporting period14 people died due to negligence as well as wrong treatment provided by their doctors. Among them 3 were women, 4 were children and 7 were others.  In the same time, 78 dead bodies were found in deferent places throughout Bangladesh. Among them 20 were women, 20 were children and 38 were others.        

Journalist and Human Rights Defender Repression:

Journalists and human rights defenders are considered to be the conscience of society. During the reporting period 14 incident of human rights violation has been perpetrated against journalist and human rights defender. Among of them, Adv. Shahanur Islam Saikot, Secretary General and Executive Director of Bangladesh Institute of Human Rights (BIHR) as well as the member of Dhaka Bar Association and Bangladesh Bar Council and also the recipient of Justice Makers Fellowship Award 2010 by International Bridges to Justice (IBJ), Switzerland for the prevention of torture through direct legal aid and human rights education has been harassed by the Rapid Action Battalion (RAB) at west side of Bangabandu Bridge, Sirajgonj abusing their power. Beside this 1 was missed, 3 were faced in false case, 5 were injured, 2 were recive death threat and 1 was attacked on the journalist house.

Violence at Garments Factory:

During the reporting period, 615 labors of garments were victimized in torture by the policemen, 2 were found death, 8 were injured by internal clashes in 15  different incident of several garment factories. Beside this more than 3000 labors were face in false case in these regards.

 Recommendation:

To promote the existing human right situation in Bangladesh, it is necessary to stop all kinds of torture and extra-judicial killing as well as other human rights violations; to form a special commission to investigate the entire incident and bring the perpetrators before the law as soon as possible. Moreover, make sensible the law enforcing agencies about the human right during their duties.
