Law Society of England and Wales Raises Concerns Over Threats to Bangladeshi Lawyer Shahanur Islam

The Law Society of England and Wales, a professional body representing approximately 200,000 solicitors, has expressed deep concerns regarding the ongoing threats and harassment faced by Bangladeshi lawyer Shahanur Islam. On 16 November , in a letter addressed to Prime Minister Sheikh Hasina of Bangladesh, the Law Society called for immediate action to safeguard Mr. Islam and uphold the rule of law.

Shahanur Islam serves as the Secretary General of the Bangladesh Institute of Human Rights and Justice Makers Bangladesh. Throughout his career, he has been an ardent defender of the rights of ethnic, religious, and LGBTI minorities, as well as opposition politicians. Regrettably, he has been a target of multiple threats, intimidation, physical assault, and arrest dating back to 2008.

সম্পত্তির ভাগ পাবেন হিজড়ারাও

রুপসা তৃতীয় লিঙ্গের একজন মানুষ। তার এক ভাই, দুই বোন। হিজড়া হওয়ায় অল্প বয়সেই বাড়ি থেকে বের হতে হয় তাকে। সম্প্রতি তার ভাই-বোনরা মুসলিম উত্তরাধিকার আইন অনুযায়ী সম্পত্তির ভাগ পেয়েছেন। রুপসাও তার বাবার কাছে গিয়ে সম্পত্তির ভাগ চেয়েছেন। বাবা তাকে স্পষ্ট জানিয়ে দিয়েছেন, যেহেতু লিঙ্গ পরিচয় নেই তাই তাকে সম্পত্তি দেয়া সম্ভব নয়। ভাই-বোনরাও মারধর করে তাকে বের করে দিয়েছে। হিজড়া হওয়ার কারণে বাবা-মায়ের সম্পত্তি থেকে বঞ্চিত হয়েছেন রুপসা। সম্পত্তির ভাগ চেয়ে আন্দোলনও করেছেন। লাভ হয়নি। মামলা করে কোন লাভ হবে না- এমন ধারণা থেকে তিনি আইনগত পদক্ষেপও নেননি। বাংলাদেশে হিজড়ারা তাদের বাবা-মায়ের সম্পত্তির ভাগ পাচ্ছেন না। বর্তমান সরকার হিজড়াদের তাদের বাবা-মায়ের সম্পত্তির ভাগ দেয়ার উদ্যোগ নিয়েছে। প্রথমে ডাক্তারী পরীক্ষার মাধ্যমে আসল ও নকল হিজড়া শনাক্ত করা হবে। এরপর প্রয়োজনে ডিএনএ পরীক্ষা করে একজন হিজড়ার শরীরে পুরুষ হরমোন রয়েছে, নাকি নারী হরমোন রয়েছে সেটি নিশ্চিত করা হবে। যদি জেনেটিক দিক দিয়ে ছেলে হয়, তাহলে তাকে মুসলিম শরিয়া আইন এবং সংবিধানের আলোকে ছেলে হিসেবে সম্পত্তির ভাগ দেয়া হবে। আর মেয়ে হলে সেই আলোকেই সম্পত্তির ভাগ দেয়া হবে।

Bangladeshi human rights organizations Bangladesh Institute of Human Rights (BIHR) and JusticeMakers Bangladesh have expressed deep concern over the incident of physically assault, snatching of gold ornaments, intimidating and threatening to close the parlor and leave the area within seven days to Monika Akhtar Moni (28), a trans woman and owners of Star World Beauty Parlor in Noorerchala bazar under Bhatara police station in Dhaka and her mother Rubina Khatun demanding extortion.

স্ত্রীর করা যৌতুক মামলায় খালাসের কথা বলে ম্যাজিস্ট্রেটের নাম ভাঙিয়ে আসামির কাছ থেকে সাড়ে ৪ লাখ টাকা আত্মসাতের অভিযোগে মো. জুয়েল মুন্সি সুমন নামে এক আইনজীবীকে আটক করা হয়েছে। এ ঘটনায় আজ বুধবার রাজধানীর কোতোয়ালি থানায় ওই আইনজীবীর বিরুদ্ধে ভুক্তভোগী আসামি বাদী হয়ে মামলা করেছেন।

বিশ্বের বিভিন্ন দেশের ন্যায় বাংলাদেশেও খুন ও ধর্ষনের মত কিছু গুরুত্বর ও ঘৃনিত অপরাধ, যা কোন ব্যক্তির কখনো সংঘটন করা উচিত নয়, সেসকল অপরাধের জন্য রাষ্ট্র অপরাধীকে মৃত্যুদণ্ডের মত গুরুদণ্ড প্রদান করে থাকে। যদিও সাধাররণত প্রাপ্ত বয়স্ক গুরুত্বর অপরাধের জন্য দায়ী ব্যক্তিদের মৃত্যুদণ্ডের মত গুরুদণ্ড প্রদান করা হলেও বিশ্বের কিছু কিছু দেশে ১৮ বছরের কম বয়সি অপরাধীকেও মৃর্ত্যুদণ্ডের মত নিষ্ঠুর, অমানবিক এবং অবমাননাকর শাস্তি প্রদান করে থাকে।   

যদিও এখন বিশ্বের অধিকাংশ রাষ্ট্র মৃর্ত্যুদণ্ডের মত নিষ্ঠুর, অমানবিক ও অবমাননাকর শাস্তি বিলোপের পক্ষে তারপরও বাংলাদেশ সহ বিশ্বের ৪২টি দেশে এখনো মৃর্ত্যুদণ্ড প্রদান করা হয়ে থাকে। যদিও তাদের মধ্যে ৮টি দেশে সাধারণ কোন অপরাধের জন্য নয় বিশেষ প্রকৃতির গুরুত্বরও ঘৃণিত অপরাধের জন্য মৃর্ত্যুদণ্ড প্রদান করা হয়ে থাকে। অন্যদিকে বিশ্বের প্রায় ৮০% অর্থাৎ১৫৫টি রাষ্ট্র আইনগত ভাবে মৃর্ত্যুদণ্ড সম্পূর্ণরূপে বাতিল করেছে বা বাস্তবিকভাবে মৃর্ত্যুদণ্ড কার্যকর করার উপর  স্থগিতাদেশ প্রদান করেছে।

BIHR and JusticeMakers Bangladesh strongly urge to Bangladesh Government to repeal the provision of death penalty in the existing law.

On the occasion of the 20th World Abolition of Death Penalty Day 2022, Bangladeshi human rights organizations Bangladesh Institute of Human Rights (BIHR) and JusticeMakers Bangladesh have called for the abolition of all clauses containing the provision of death penalty in the existing laws in Bangladesh. Today, on October 10, 2022, BIHR and JusticeMakers Bangladesh urged to the government of the People’s Republic of Bangladesh to abolish death penalty.

Advocate Shahanur Islam, Secretary General of JusticeMakers Bangladesh and BIHR, has demanded for life imposing life imprisonment in serious crimes instead of death penalty to avoid cruel, inhuman and humiliating punishments like death penalty.

Bangladeshi Human rights organizations Bangladesh Institute of Human Rights (BIHR) and JusticeMakers Bangladesh have expressed deep concern over the recent case of physically assault and extortion after wrongfully confinement of a homosexual gay minority youth boy in Mirpur area of ​​Dhaka.

At the same time, BIHR and JusticeMakers Bangladesh strongly demanded that all the criminals directly or indirectly involved in the incident should be quickly identified and arrested and given exemplary punishment with due process.

প্রতারণার মামলায় আইনজীবীর কারাদণ্ড

BIHR and JusticeMakers Bangladesh urge the concern authority of Bangladesh to arrest all the culprits who were involved with the said brutal murder of transgender and bring the culprits before the book after quick and impartial investigation.  

According to the news published online version of New Age on 30 September 2022 that a member of the transgender community was stabbed to death in Dhaka’s Paribagh area early Friday.  Nila,( 24), was stabbed by two youths on the footbridge at Paribagh at around 1:30am, police said.
