BIHR and Justice Makers Bangladesh have demanded that all the criminals involved in the incident should be identified and arrested promptly and exemplary punishment should be given to those responsible by filing a case against them regarding the incident and providing overall security to the victim trans woman and other members of her family.
Victim Trans woman Moni told to BIHR and Justicemakers Bangladesh Secretary General and prominent lawyer and gay rights activist Advocate Shahanur Islam on mobile phone that on Monday, October 10, 2022, the victim transg women organized a birthday function at a community center, where she exchanged garlands with her boyfriend in front of the invited guests.
Knowing this, on 11th October, Tuesday, 30 to 40 hijras led by Pinki Hijra came to her Star World Beauty Parlier and demanded 10,000 bdt as extortion.The victimized transgender woman paid them four thousand taka.
On Wednesday, October 12, at around 3 pm, 30 to 40 hijras led by Pinki Hijra once again came to her business establishment and attacked her simultaneously, asking to know why she married another boy as she is a boy. The accused hijras took her outside the parlor by her hair, stripped her completely naked, slapped her all over her body, and left her with swollen and bloody wounds all over her body.
When the victim's mother tried to save her, she was also beaten and injured by the accused hijras. At that time, the accused hijras snatched the gold chain worn on the neck, gold bangle worn on the hand, gold pendant worn on the ear and diamond ring on the fingers of the victim. The accused hijras recorded the entire incident on mobile phones. Later they threatened to kill her and her family members, if she report to the police station about the incident and she did not left the place closing down her business within seven days.
BIHR and JusticeMakers Bangladesh Secretary General and eminent lawyer and gay rights activist Advocate Shahanur Islam expressed strong protest and anger over the extortion, physical torture, nude video recording, warning to shut down the business within seven days and threats of death for failing to leave the area to the Trans woman.
Advocate Shahanur Islam believes that the mentioned incident is not an isolated incident in Bangladesh, rather it is only a small part of the ongoing human rights violations like discrimination, killing, injury, humiliation against people of the LGBT community, including transgender women, across the country.
Advocate Shahanur Islam also opined that although Bangladesh government has taken some social rehabilitation initiatives by recognizing Hijras as the third gender, but those are not effective enough as Hijras have been involved in criminal activities at various times.
Moreover, due to family, social and state unacceptability and intolerance, the members of the Hijra community are constantly subjected to various human rights violations including discrimination, and because of their unhealthy mental development, they are involved in various criminal activities such as extortion, drug trade, smuggling, advocate Shahanur Islam also thinks.
Finally, Advocate Shahanur Islam demanded constitutional recognition of the LGBT community by repealing Section 377 of the Penal Code and enacting a law to protect members of the LGBT community immediately.
ঢাকায় চাঁদার দাবীতে যৌন সংখ্যালঘু রুপান্তরকামী মহিলা ও তার মাকে নির্যাতনের ঘটনায় অভিযুক্ত ব্যক্তিদের অবিলম্বে গ্রেফতারপুর্বক বিচারে দৃষ্ঠান্তমূলক শাস্তি প্রাদান করা হোক।
ঢাকার ভাটারা থানাধীন নুরের চালা বাজারের স্টার ওয়ার্ল্ড র্বিউটি পারলারের স্বত্তাধিকারী যৌন সংখ্যালঘু রুপান্তরকামী মহিলা মনিকা আক্তার মনি (২৮) ও তার মা রুবিনা খাতুনকে চাঁদার দাবীতে শারীরিক নির্যাতন, স্বর্ণালংকার ছিনিয়ে নেয়া, ভয়ভীতি প্রদর্শণ ও সাত দিনের মধ্যে পার্লার বন্ধ করে এলাকা ছেড়ে চলে যাওয়ার হুমকি প্রদানের ঘটনায় মানবাধিকার প্রতিষ্ঠান বাংলাদেশ ইনস্টিটিউট অব হিউম্যান রাইটস (বিআইএইচআর) এবং জাস্টিসমেকার্স বাংলাদেশের গভীর উদ্বেগ প্রকাশ করেছে।
উক্ত ঘটনার বিষয়ে মামলা দায়ের করে ঘটনার সাথে জড়িত সকল অপরাধীকে দ্রুত চিহ্নিত করে গ্রেফতার পূর্বক দায়ীদের দৃষ্ঠান্তমূলক শাস্তি প্রদান সহ ভুক্তভোগী রুপান্তরকামী মহিলা ও তার পরিবারের অন্যান্য সদস্যকে সার্বিক নিরাপত্তা প্রদানের জোড় দাবী জানিয়েছে বিআইএইচআর এবং জাস্টিসমেকার্স বাংলাদেশ ।
ভুক্তভোগী রুপান্তরকামী মহিলা বিআইএইচআর এবং জাস্টিসমেকার্স বাংলাদেশের মহাসচিব এবং বিশিষ্ট আইনজীবী ও সমকামী অধিকারকর্মী অ্যাডভোকেট শাহানুর ইসলাম সৈকতকে মোবাইল ফোনে জানান, গত ১০ অক্টোবর ২০২২ খ্রীষ্টাব্দ সোমবার ভুক্তভোগী রূপান্তরকামী মহিলা এক কমিউনিটি সেন্টারে জন্মদিন উপলক্ষে একটি অনুষ্ঠানের আয়োজন করে। উক্ত অনুষ্ঠানে আমন্ত্রিত অতিথিদের সামনে তার তার বয়ফ্রেণ্ডের সাথে মালা বদল করে।
বিষয়টি জেনে গত ১১ অক্টোবর মঙ্গলবার পিংকি হিজড়ার নেতৃত্বে ৩০/৪০ জন হিজড়া তার ব্যবসায় প্রতিষ্টানে এসে দশ হাজার টাকা দাবী করে। ভুক্তভোগী রুপান্তরকামী নারী তাদের চার হাজার টাকা প্রাদান করে।
গত ১২ অক্টোবর বুধবার বিকাল আনুমানিক ৩ ঘটিকায় আবারো পিংকি হিজড়ার নেতৃত্বে ৩০/৪০ জন হিজড়া তার ব্যবসায় প্রতিষ্ঠানে এসে কেন সে ছেলে হয়ে আর একটি ছেলেকে বিয়ে করেছে তা জানতে চেয়ে একযোগে তার উপর আক্রমন করে। অভিযুক্ত হিজড়ারা চার চুলে ধরে পার্লারের বাহিরে বাহির করে তাকে সম্পূর্ণ নগ্ন করে তার সারা শরীরে এলোপাথারী কিল ঘুসি লাথি চর থাপ্পড় মেরে সারা শরীরে ছিলা ফোলা রক্তাভ যখম করে।
ভুক্তভোগী রুপান্তরকামী মহিলার মা তাকে বাঁচাতে আসলে তাকেও অভিযুক্ত হিজরারা মারধর করে যখম করে। উক্ত সময় অভিযুক্ত হিজড়ারা ভুক্তভোগী রুপান্তরকামী মহিলার গলায় পরিহিত সোনার চেইন, হাতে পরিহিত সোনার বালা, কানে পরিহিত সোনার দুল এবং আঙ্গুলে পরিহিত দায়মণ্ডের আংগটি ছিনিয়ে নেয়। অভিযুক্ত হিজড়ারা পুরো ঘটনাটির ভিডিও মোবাইল ফোনে ধারন করে। উক্ত ঘটনার বিষয়ে যদি থানায় অবগত করে এবং সাত দিনের মধ্যে যদি ভুক্তভোগী রুপান্তরকামী মহিলা তার ব্যবসায় প্রতিষ্টান বন্ধ করে চলাকা ছেড়ে চলে না যায় তবে তাকে ও তার পরিবারের সদস্যদের হত্যা করার হুমকি প্রদান করে ঘটনাস্থল ত্যাগ করে।
বিআইএইচআর এবং জাস্টিসমেকার্স বাংলাদেশের মহাসচিব এবং বিশিষ্ট আইনজীবী ও সমকামী অধিকারকর্মী অ্যাডভোকেট শাহানুর ইসলাম সৈকত ঢাকায় হিজরা গুরুমার নেতৃত্ত্বে রুপান্তরকামী মহিলা ও তার মাকে চাঁদার দাবীতে শারীরিক নির্যাতন, নগ্ন করে ভিডিও ধারণ, সাত দিনের মধ্যে ব্যবসায় প্রতিষ্ঠান গুটিয়ে এলাকা ছেড়ে চলে যাওয়ার হুশিয়ারি প্রাদন ও ব্যর্থতায় খুন যখমেরহুমকি প্রদানের ঘটনায় তীব্র প্রতিবাদ ও ক্ষোভ প্রকাশ করেছেন।
অ্যাডভোকেট শাহানূর ইসলাম মনে করেন যে, উল্লেখিত ঘটনাটি বাংলাদেশের কোনো বিচ্ছিন্ন ঘটনা নয়,বরং সারা দেশে রুপান্তরকামী মহিলা সহ এলজিবিটি সম্প্রদায়ের ব্যক্তিদের বিরুদ্ধে ব্যাপকভাবে চলমান বৈষম্য, হত্যা, আঘাত, অপমানের মত মানবাধিকার লংঘন বিষয়ের একটি ক্ষুদ্র অংশ মাত্র।
অ্যাডভোকেট শাহানুর ইসলাম আরও মনে করেন যে যদিও বাংলাদেশ সরকার হিজড়াদের তৃতীয় লিঙ্গ হিসেবে স্বীকৃতি প্রদান করে সামাজিকভাবে পুনর্বাসনের কিছু উদ্যোগ নিয়েছে,কিন্তু তা যথেষ্ট কার্যকরী নয় বিধায় হিজড়ারা বিভিন্ন সময়ে অপরাধ্মূলক কার্যকলাপের সাথে জড়িত হয়ে পড়েছে।
তাছাড়া,পারিবারিক, সামাজিক ও রাষ্ট্রীয় অগ্রহণযোগ্যতা ও অসহিষ্ণুতার জন্য হিজড়া সম্প্রদায়ের সদস্যরা প্রতিনিয়ত বৈষম্যসহ বিভিন্ন মানবাধিকার লঙ্ঘনের শিকার হওয়ার তাদের সুস্থ মনোবিকাশ ব্যহত হওয়ার কারণে তারা চাঁদাবাজি, মাদক ব্যবসায়, চোরাচালানের মত বিভিন্ন অপরাধমূলেক কর্মকাণ্ডে জড়িত হচ্ছে বলেও অ্যাডভোকেট শাহানুর ইসলাম মনে করেন।
পরিশেষে, অ্যাডভোকেট শাহানূর ইসলাম অনতিবিলম্বে যৌন সংখ্যালঘু এলজিবিটি সম্প্রদায়ের সাংবিধানিক স্বীকৃতি প্রদান পূর্বক দন্ডবিধিরা ৩৭৭ ধারা বিলোপ করে যৌন সংখ্যালঘু এলজিবিটি সম্প্রদায়ের সদস্যদের সুরক্ষা আইন প্রণয়নের জোড় দাবি জানিয়েছেন।
