Human rights organizations BIHR and JusticeMakers Bangladesh have expressed extreme concern and protest over the order not to take classes to a homosexual teacher of Savar Model College.BIHR and JusticeMakers Bangladesh believe that
because of being a teacher
of homosexual nature, refrain him from taking classes is a clear violation of
the Constitution of the People's Republic of Bangladesh and the United Nations
Declaration of Human Rights, due to students protest patronized by
the homophobic
people.
On 28 and 29 August 2022, the news published in various
electronic and print media revealed that the Upazila Nirbahi Officer (UNO) has
ordered Ramzan Ali, a homosexual teacher, to refrain from taking classes due to continued students' agitation in
Savar Model College.
On Monday (August 29) noon, UNO rushed to the college after
receiving the news of Savar Model College students' agitation for the 2nd
consecutive day. After a long discussion with the protesting students, he
announced this decision.
Earlier, thousands of students of Savar Model College
boycotted classes from Sunday (August 28) morning and demanded the withdrawal
of homosexual Ramzan Ali, the teacher of the Islamic department of the
institution.
Savar Upazila Executive Officer (UNO) Md. Mazharul
Islam said, due to
continuous agitation of the students, Ramzan Ali, the teacher of the college,
has been asked to refrain from taking classes. He also said that the
teacher will not be able to attend the class until further instructions.
Incidentally, in 2008, an investigation committee was formed
as per the instructions of the Board of Secondary and Higher Secondary
Education, Dhaka authorities on the allegation of homosexuality with a
student. After the investigation found the allegations to be true, the
college sent a letter to Ramzan Ali asking for his statement. But he did
not come to the college and filed a case in the lower court. However, when
the case was dismissed due to non-appearance in that case, he later filed
another case which is currently pending in the Supreme Court.
In such a situation, when the teacher took the class of the students, the
students boycotted the class and started the movement. During the second
day of the agitation on Monday, Savar upazila executive officer held a closed
meeting with teachers and students to resolve the heated situation. Later,
with everyone's consent, the accused Ramzan Ali was ordered to be stopped from
taking classes.
The complaint of the students, against whom the charges of
homosexuality were proved, is why the college authorities brought
him again.
The assistant professor of the college, Munsur Ali said, where a male student are not safe from a
homosexual teacher, how can female students be safe from him?
Mrs. Dilara Khanam, the principal in charge of the institution
said, "There was a class after I came to the college in the
morning. Later I saw that there was no sir in the college and the students
were roaming outside. Besides, the students did not tell me about the
demands on which they protested by boycotting the classes. On the other
hand, he questioned how the students now know about Ramzan Ali's dismissal for
homosexuality with a student 14 years ago. For this, she claimed that there is
grouping inside the college and said that the opponent is inciting the
students.
Advocate Shahanur Islam, Secretary General of human rights
organization BIHR and JusticeMakers Bangladesh as well as a
gay rights campaigner,
has expressed strong anger and protest over the order to refrain from taking classes to the homosexual
teacher of Savar Model College.
At the same time, Advocate Shahanur Islam has demanded that
the persons responsible for inciting and patronizing the students in the incident
should be identified and handed over to trial and exemplary punishment should
be given.
Advocate Shahanur Islam also opined that no one can be
called a criminal when a charge is filed against him, unless he is found guilty
after due process of law.
Since, the accused sexual minority homosexual teacher Ramzan
Ali was not found guilty of male child rape by the court verdict,
even there was no case against him in any court of the country for male child rape or any other case
against him in any court of the country, Therefore, ordering him not to take
classes in the college on the charge of homosexuality is collusive and against
the law, Advocate Shahanur thinks.
Advocate Shahanur Islam believes that if a person is
involved in a heinous crime like male child rape, exemplary punishment
should be given through a transparent judicial process as per the existing laws
of the country. However, Advocate Shahanur Islam feels
that under no circumstances should anyone be punished only on the charge of
homosexuality.
Advocate Shahanur Islam also thinks that not allowing the
sexual minority homosexual teacher of Savar Model College to return to the
classroom is not only discrimination against the homosexual teacher, but also violation
of his basic human rights recognized by the constitution.
Finally,
Advocate Shahanur Islam demanded that the of homosexual teacher to be returned
to the classes room quickly with due dignity; besides identifying the responsible
persons involved in violating the basic human rights of the homosexual teacher
and providing exemplary punishment and ensuing his adequate safety, security and
protection as well as providing him appropriate compensation.

সাভার মডেল কলেজের সমকামি শিক্ষককে ক্লাস না নেওয়ার নির্দেশ প্রাদানের ঘটনায় মানবাধিকার প্রতিষ্ঠান বিআইএইচআর এবং জাস্টিসমেকার্স বাংলাদেশ উদ্বেগ ও প্রতিবাদ জানিয়েছে।
শুধুমাত্র সমকামী প্রকৃতির শিক্ষক হওয়ায় হোমোফোবিক ব্যক্তিদের প্ররোচনা ও উস্কানিতে ছাত্র-ছাত্রীদের প্রতিবাদের মুখে যৌন সংখ্যালঘু সমকামী শিক্ষককে ক্লাশ না নেওয়ার নির্দেশনা দেয়ার ঘটনা গণপ্রজাতন্ত্রী বাংলাদেশ সংবিধান ও জাতিসংঘ মানবাধিকার ঘোষণাপত্রের সুস্পষ্ট লংঘন বলে বিআইএইচআর এবং জাস্টিসমেকার্স বাংলাদেশ মনে করে।
গত ২৮ ও ২৯ আগষ্ট ২০২২ খ্রীষ্টব্দ তারিখে বিভিন্ন ইলেক্ট্রনিক ও প্রিন্ট মিডিয়ায় প্রকাশিত খবরে জানা যায় যে, সাভার মডেল কলেজে শিক্ষার্থীদের অব্যাহত আন্দোলনের মুখে সমকামি শিক্ষক রমজান আলীকে ক্লাস নেওয়া থেকে বিরত থাকার নির্দেশ দিয়েছেন উপজেলা নির্বাহী কর্মকর্তা (ইউএনও) মো. মাজহারুল ইসলাম।
সোমবার (২৯ আগস্ট) দুপুরে সাভার মডেল কলেজ শিক্ষার্থীদের টানা ২য় দিনের আন্দোলনের খবর পেয়ে কলেজে ছুটে আসেন ইউএনও। পরে আন্দোলনরত শিক্ষার্থীদের দীর্ঘ্য আলোচনা শেষে এই সিদ্ধান্তের কথা জানিয়েছেন তিনি।
এর আগে,রোববার (২৮ আগষ্ট) সকাল থেকেই সাভার মডেল কলেজের সহস্রাধিক শিক্ষার্থী ক্লাস বর্জন করে প্রতিষ্ঠানটির ইসলামী বিভাগের শিক্ষক সমকামি রমজান আলীকে প্রত্যাহারের দাবি জানিয়েছে শিক্ষার্থীরা।
সাভার উপজেলা নির্বাহী কর্মকর্তা (ইউএনও) মো. মাজহারুল ইসলাম বলেন,শিক্ষার্থীদের অব্যাহত আন্দোলনের মুখে কলেজের শিক্ষক রমজান আলীকে ক্লাস নেওয়া থেকে বিরত থাকতে বলা হয়েছে। পরবর্তী নির্দেশ না দেওয়া পর্যন্ত ওই শিক্ষক ক্লাসে উপস্থিত থাকতে পারবে না বলেও জানিয়েছেন তিনি।
প্রসঙ্গত,গত ২০০৮ সালে এক শিক্ষার্থীর সাথে সমকামীতার অভিযোগে মাধ্যমিক ও উচ্চমাধ্যমিক শিক্ষা বোর্ড, ঢাকা কর্তৃপক্ষের নির্দেশনা অনুযায়ী একটি তদন্ত কমিটি গঠন করা হয়। তদন্তে অভিযোগের সত্যতা পাওয়ায় এবং আরও বেশ কয়েকজন ছাত্রের সাথে একই ঘটনা ঘটানোর অভিযোগ উঠায় কলেজ থেকে রমজান আলীকে চিঠি দিয়ে তার বক্তব্য জানতে চাওয়া হয়। কিন্তু তিনি কলেজে না এসে নিম্ন আদালতে একটি মামলা দায়ের করেন। তবে ওই মামলায় হাজিরা না দেয়ার কারণে মামলাটি খারিজ হয়ে গেলে সে পরবর্তীতে আরও একটি মামলা করেন যা বর্তমানে সুপ্রিমকোর্টে চলমান রয়েছে।
এমনবস্থায় উক্ত শিক্ষক কলেজে যোগদান করে শিক্ষার্থীদের ক্লাস নিতে চাইলে শিক্ষার্থীরা ক্লাস বর্জন করে আন্দোলনে নামেন। সোমবার দ্বিতীয় দিনের আন্দোলন চলাকালে উত্তপ্ত পরিস্থিতি নিরসনের জন্য শিক্ষক ও শিক্ষার্থীদের সাথে রুদ্ধধার বৈঠক করেন সাভার উপজেলা নির্বাহী কর্মকর্তা। পরে সকলের সম্মতিক্রমে অভিযুক্ত রমজান আলীকে ক্লাস নেওয়া থেকে বিরত রাখার নির্দেশ দেয়া হয়।
শিক্ষার্থীদের অভিযোগ,যার বিরুদ্ধে সমকামিতার অভিযোগ প্রমাণিত হওয়ায় বরখান্ত করা হয়েছে তাকেই কেন আবার কলেজ কর্তৃপক্ষ নিয়ে এসেছে।
কলেজটির সহকারী অধ্যাপক মো. মুনসুর আলী বলেন,যেখানে একজন সমকামী শিক্ষকের কাছে ছাত্ররাই নিরাপদ নয়, সেখানে ছাত্রীরা কিভাবে তার কাছে নিরাপদ এটা আপনাদের কাছে প্রশ্ন রইল।
প্রতিষ্ঠানটির দায়িত্বপ্রাপ্ত অধ্যক্ষ দিলারা খানম বলেন,আমি সকালে কলেজে আসার পর একটি ক্লাস হয়েছে। পরবর্তীতে দেখি কলেজে স্যার নাই এবং শিক্ষার্থীরা বাইরে ঘুরাঘুরি করছে। এ ছাড়া শিক্ষার্থীরা যেসব দাবিতে ক্লাস বর্জন করে বিক্ষোভ করেছে সে বিষয়টি আমাকে জানায়নি। অন্যদিকে ১৪ বছর আগে এক ছাত্রর সাথে সমকামীতার অভিযোগে রমজান আলীকে বরখাস্তের বিষয়টি এখন কিভাবে শিক্ষার্থীরা জানল সেই প্রশ্ন তোলেন। এ জন্য তিনি কলেজের ভেতরে গ্রুপিং রয়েছে দাবি করে বলেন,প্রতিপক্ষই শিক্ষার্থীদের উসকে দিচ্ছে।
মানবাধিকার প্রতিষ্ঠান বিআইএইচআর এবং জাস্টিসমেকার্স বাংলাদেশ এর মহাসচিব বিশিষ্ট মানবাধিকার আইনজীবী ও সমকামী অধিকার আন্দোলনকর্মী অ্যাডভোকেট শাহানূর ইসলাম সৈকত সাভার মডেল কলেজের সমকামী শিক্ষককে ক্লাশ না নেয়ার নির্দেশ প্রদানের ঘটনায় তীব্র ক্ষোভ ও প্রতিবাদ জানিয়েছেন।
একইসাথে যথাযথ তদন্তপূর্বক উক্ত ঘটনায় ছাত্র ছাত্রীদের প্ররোচনা ও উস্কানি প্রদানকারী দায়ি ব্যক্তিদের চিহ্নিতপূর্বক বিচারে সোপর্দ করে দৃষ্ঠান্তমূলক শাস্তি প্রদানের জোড় দাবী জানিয়েছে অ্যাডভোকেট শাহানূর ইসলাম সৈকত।
অ্যাডভোকেট শাহানূর ইসলাম সৈকত আরো মনে করেন যে, কারও বিরুদ্ধে অভিযোগ উত্থাপিত হলেই তাকে অপরাধী বলা যায় না, যতক্ষন না তিনি যথাযথ আইনগত প্রক্রিয়ার বিচার অন্তে দোষী স্বাব্যস্থ না হোন।
যেহেতু, অভিযুক্ত যৌন সংখ্যালঘু সমকামী শিক্ষক রমজান আলী আদালতের রায়ে ছেলে শিশু ধর্ষণের দায়ে দোষী প্রমানিত হয়নি, এমনকি তার বিরুদ্ধে প্রচলিত আইনে ছেলে শিশু ধর্ষণের অভিযোগে দেশের কোন আদালতে কোন মামলাও হয়নি বা দেশের কোন আদালতে তার বিরুদ্ধে ছেলে শিশু ধর্ষণ বা অন্য কোন মামলা চলমান নেই, সেহেতু তাকে সমকামীতার অভিযোগে কলেজে ক্লাশ না নেওয়ার নির্দেশ প্রদান করাটা পরস্পর যোগসাজসী ও আইন বিরোধী বলেই অ্যাডভোকেট শাহানূর মনে করেন।
অ্যাডভোকেট শাহানূর ইসলাম সৈকত বিশ্বাস করেন যে, যদি কোন ব্যক্তি ছেলে শিশু ধর্ষণের মত ঘৃনিত অপরাধে জড়িত থাকে তবে দেশের প্রচলিত আইনে যথযথ স্বচ্ছ বিচার প্রক্রিয়ার মাধ্যমে দৃষ্টান্তমূলক শাস্তি প্রদান করতে হবে। তবে, কোন অবস্থায় শুধুমাত্র সমকামীতার অভিযোগে কাউকে শাস্তি প্রদান করা যাবে না বলেই অ্যাডভোকেট শাহানূর ইসলাম মনে করেন।
অ্যাডভোকেট শাহানূর ইসলাম সৈকত আরো মনে করেন যে, সাভার মডেল কলেজের উক্ত যৌন সংখ্যালঘু সমকামী শিক্ষককে ক্লাশে ফিরতে না দেয়ার ঘটনায় শুধুমাত্র উক্ত সমকামী শিক্ষকের প্রতি শুধু বৈষম্য করাই হয়নি, বরং তার সংবিধান স্বীকৃত মৌলিক মানবাধিকার লংঘন করা হয়েছে।
সর্বশেষ, উক্ত যৌনসখ্যালঘু সমকামী শিক্ষককে যথাযথ মর্যাদায় দ্রুত ক্লাশে ফিরানোর পাশাপাশি উক্ত শিক্ষকের মৌলিক মানবাধিকার লঙ্ঘনকারীদের সাথে জড়িত দায়ী ব্যক্তিদের চিহ্নিতপূর্বক বিচারে দৃষ্টান্তমূলক শাস্তি প্রদান এবং তার যথাযথ নিরাপত্তা নিশ্চিতকরণ ও উপযুক্ত ক্ষতিপূরণ প্রদানের জোড় দাবী জানিয়েছেন অ্যাডভোকেট শাহানূর ইসলাম সৈকত।
