Human rights organization JusticeMakers Bangladesh has expressed deep concern over the threat of cross fire to Dhaka Lawyers Association senior advocate Aminul Goni Titu in the court premises for performing his professional duties.
At the same time, Justice Makers Bangladesh has called for a judicial equery committee headed by a justice of the High Court to identify the responsible police officer and take appropriate measures under the departmental and criminal law.
According to the news published in various newspapers and the information obtained from reliable sources, it is known that on February 7, Advocate Aminul Gani was cross-examining the accused in a case at the Second Joint District and Sessions Judge Court of Dhaka.
At that time, one Mukarram Hossain Jimmy, was helping to the complainant to giving answers of cross-examination. In his view, the lawyer present in the court. Salim Hossain and Istiaq Uddin prevented the man from providing the answer.
That person got angry and started shouting in the courtroom. If the matter comes to the attention of the judge, the court orders the person to leave the courtroom.
Later, Mokarram Hossain Jimi, along with police officer Nazmul, took pictures of the two lawyers who were obstructing the delivery of the answer with his mobile phone and took the initiative to arrest them, while Advocate Aminul Gani came out of the courtroom after the cross-examination hearing.
That time, the police officer Nazmul threatened to kill Aminul Gani Titu by cross fire picking up from court premise . The lawyers present at that time protested and save them from the police officials and others. Later, they entered the courtroom of the Second Joint District and Sessions Judge's Court and informed the judge about the matter.
Founder Secretary General of JusticeMakers Bangladesh and eminent human rights lawyer Advocate Shahanur Islam strongly condemned and protested the incident and immediately demanded that the members of law enforcement agencies and others involved in the incident be identified and given exemplary punishment in the trial. Besides, Advocate Shahanur Islam demanded to take necessary measures to provide full security to the victim lawyer and his family.
Advocate Shahanur Islam thinks that the ugly incident like the police picking up a lawyer in the court premises and threatening to kill him in crossfire just because he is conducting professional work is a sign of showing thumb to the rule of law and judicial system.
Advocate Shahanur Islam firmly believes that the incident is a clear violation of the Constitution of the People's Republic of Bangladesh and the principles declared by the United Nations regarding the professional freedom of lawyers.
Moreover, the incident of threatening a lawyer with crossfire in the court premises is not an isolated incident, rather physical attacks on lawyers, arrests, torture in police custody, murder, threats of crossfire have become a common issue in Bangladesh.
In the month of January, Advocate Rashid Mollah was brutally hacked and seriously injured in Keraniganj, Advocate Abul Hossain Rajon was picked up by the police and brutally tortured and sent to jail custody on a false case, and the attack on a prominent environmental lawyer Syeda Rizwana Hasan and his team in Chittagong are tied in a line, advocate Shahanur Islam believes.
Above all, Advocate Shahanur Islam strongly demanded the formulation of Lawyers Protection Act in the light of the principles declared by the United Nations regarding the professional freedom of lawyers to ensure the professional dignity and independence of lawyers.

একইসাথে, উক্ত ঘটনায় হাইকোর্ট বিভাগের বিচারপতির নেতৃত্বে বিচার বিভাগীয় কমিটি গঠন করে দ্রুত সুষ্ঠ তদন্ত পুর্বক দায়ী পুলিশ অফিসারকে চিহ্নিত করে বিভাগীয় ও ফৌজদারী আইনে যথোপযুক্ত ব্যবস্থা গ্রহনের আহবান জানিয়েছে জাস্টিসমেকার্স বাংলাদেশ।
বিভিন্ন পত্রিকায় প্রকাশিত খবর ও নির্ভরযোগ্য সুত্রে প্রাপ্ত তথ্যে জানা যায় যে, গত ০৭ ফেব্রুয়ারী তারিখে ঢাকার দ্বিতীয় যুগ্ম জেলা ও দায়রা জজ আদালত এজলাসে একটি মামলায় আসামি পক্ষে জেরা করছিলেন অ্যাডভোকেট আমিনুল গণী। সে সময় বাদী পক্ষের জনৈক মোকাররম হোসেন জিমি সাক্ষীর কাঠগড়ায় দাঁড়ানো বাদীকে ইশারা-ইঙ্গিতে জেরার উত্তর সরবরাহ করছিলেন। তার পরিপ্রেক্ষিতে এজলাসে উপস্থিত আইনজীবী মো. সেলিম হোসেন ও ইসতিয়াক উদ্দিন উত্তর সরবরাহে ওই ব্যক্তিকে বাধা প্রদান করেন। তাতে উক্ত ব্যক্তি ক্ষিপ্ত হয়ে বিচার কক্ষেই চেঁচামেচি শুরু করে। বিষয়টি বিচারকের দৃষ্টি গোচর হলে বহিরাগত বিবেচনায় উক্ত ব্যক্তিকে এজলাস থেকে বের হয়ে যাওয়ার আদেশ দেন আদালত।
পরে জেরা শুনানি শেষে অ্যাডভোকেট আমিনুল গণী এজলাস থেকে বের হওয়ায় সময় দরজার কাছে দাঁড়িয়ে মোকাররম হোসেন জিমি পুলিশ অফিসার নাজমুলকে সঙ্গে নিয়ে উত্তর সরবরাহে বাধা প্রদানকারী দুই আইনজীবীর ছবি মোবাইল ফোনে ধারণ করেন ও তাদের গ্রেফতারের উদ্যোগ নেন।তাতে বাধা দেওয়ায় পুলিশ সদস্যরা এবং বহিরাগত ওই ব্যক্তি অ্যাডভোকেট আমিনুল গণীকে তুলে নিয়ে গিয়ে ক্রসফায়ারে হত্যার হুমকি প্রদান করে। সেসময় উপস্থিত আইনজীবীরা প্রতিবাদ করেন এবং দ্বিতীয় যুগ্ম জেলা ও দায়রা জজ আদালতের এজলাসে প্রবেশ করে বিচারককে বিষয়টি অবহিত করেন।
জাস্টিসমেকার্স বাংলাদেশ এর প্রতিষ্ঠাতা মহাসচিব ও বিশিষ্ট মানবাধিকার আইনজীবী অ্যাডভোকেট শাহানূর ইসলাম উক্ত ঘটনার তীব্র নিন্দা ও প্রতিবাদ জানিয়ে অবিলম্বে ঘটনার সাথে জড়িত আইন শৃংখলা রক্ষাকারী বাহীনির সদস্য সহ অন্যান্যদের চিহ্নিত করে বিচারে দৃষ্টান্তমূলক শাস্তি প্রদানের জোর দাবী জানিয়েছেন। পাশাপাশি ভুক্তভোগী আইনজীবী ও তার পরিবারের পূর্ণ নিরাপত্তা প্রদানের প্রয়োজনীয় ব্যবস্থা গ্রহনের জোর দাবী জানিয়েছেন অ্যাডভোকেট শাহানূর ইসলাম।
অ্যাডভোকেট শাহানূর ইসলাম মনে করেন শুধুমাত্র পেশাগত কার্য পরিচালনা করায় পুলিশ কর্তৃক আদালত চত্ত্বরে একজন আইনজীবীকে তুলে নিয়ে ক্রস ফায়ারে হত্যার হুমকি প্রদান করার মত ন্যাকারজনক ঘটনা আইনের শাসন ও বিচার ব্যবস্থাকে বৃদ্ধাঙ্গুলি দেখানোর নামান্তর। উক্ত ঘটনা গণপ্রজাতন্ত্রিক বাংলদেশ সংবিধান এবং আইনজীবীদের পেশাগত স্বাধীনতা সম্পর্কিত জাতিসংঘ ঘোষিত মূলনীতির সুস্পষ্ট লঙ্ঘন বলে অ্যাডভোকেট শাহানূর ইসলাম দৃঢ় বিশ্বাস করেন।
তাছাড়া, আদালত চত্ত্বরে আইওনজীবীকে ক্রস ফায়ারে হুমকি দেয়ার ঘটনা কোন বিচ্ছিন্ন ঘটনা নয়, বরং সারা বাংলাদেশে আইনজীবীদের উপর সংঘটিত শারীরিক আক্রমণ, গ্রেফতার, পুলিশ হেফাজতে নির্যাতন, হত্যা, ক্রস ফায়ারের হুমিক একটি সাধারণ বিষয় হয়ে দাঁড়িয়েছে। জানুয়ারী মাসে কেরানীগঞ্জে অ্যাডভোকেট রশিদ মোল্লাকে নির্মম্ভাবে কুপিয়ে গুরুতর আহত করা, অ্যাডভোকেট আবুল হোসেন রাজনকে ডাকায় পুলিশ তুলে নিয়ে নির্মমভাবে নির্যাতন করে মিথ্যা মামলায় জেলহাজতে প্রেরণ এবং বিশিষ্ট পরিবেশ আইনজীবী ও তার দলের উপর চট্রগ্রামে আক্রমনের ঘটনাগুলো একইসূত্রে গাঁথা বলেই অ্যাডভোকেট শাহানূর ইসলাম মনে করেন।
সর্বপরি, অ্যাডভোকেট শাহানূর ইসলাম আইনজীবীদের পেশাগত মর্যাদা ও স্বাধীনতা নিশ্চিত করতে আইনজীবীদের পেশাগত স্বাধীনতার সংক্রান্ত জাতিসংঘ ঘোষিত মূলনীতির আলোকে আইনজীবী সুরক্ষা আইন প্রণয়নের জোড় দাবী জানিয়েছেন।
