France-based human rights organization, JMBF, calls for the identification of the accused through an impartial investigation led by a High Court Judge and the immediate, unconditional release of the arrested lawyers, along with the dropping of all charges against them.
Based on reports published in various online and print newspapers in Bangladesh over the past two weeks, it has come to our attention that on the night of October 30, 2023, around at 8 pm, Advocate S.M. Mojammel Hossain Alal, a lawyer of the Supreme Court of Bangladesh and the Central Committee Joint Secretary of the Bangladesh Nationalist Party (BNP), was arrested from his residence in the Kathalbagan area of the capital. He was arrested on multiple charges related to the recent gatherings and demonstrations by the BNP and subsequently sent to jail custody. Before this, on the morning of October 29, in Dhaka, the Detective Branch (DB) police conducted a raid on his residence in Lalmatia, conducting searches in every room but failing to locate him. Later in the day, around noon, DB police entered his Banani residence too.
On October 29 (Sunday) at around 10:30 am in Faridpur, the police arrested five lawyers by baton-charging the procession of the Nationalist Lawyers Forum in the court premises in support of the morning-evening hartal called by BNP-Jamaat. The arrested lawyers are District Lawyers Forum President Advocate Ali Ashraf Nannu, Advocate Tarek Ayub Khan, Advocate Zahidul Islam Labloo, Advocate Khasrul Alam, and Advocate Nazrul Islam. In support of the hartal, the Nationalist Lawyers Forum took out a protest march in the court premises in the morning. When the procession of Nationalist Lawyers Forum in support of the hartal proceeded in front of the Deputy Commissioner's office and in front of Laldighi Pond Market towards Independence Square, the police dispersed them with batons and arrested five lawyers from there and sent them to jail.
On the night of October 27 (Friday), the intelligence police arrested 9 lawyers and sent them to jail in connection with the gathering and demonstration organized by the BNP in front of their central office in the capital to demand the fall of the government. The arrested lawyers are Supreme Court Lawyers, Bangladesh Nationalist Lawyers Forum, Central Committee Co-Environmental Affairs Secretary and Nationalist Youth Party, Central Committee Co-Legal Affairs Secretary Advocate Noore Alam Siddiqui Sohag, Advocate Manjurul Alam Sujan, Advocate Jewel Munsi Suman, Advocate Nurullah, Advocate Saiful Islam, and three lawyers of Chittagong bar: Advocate Mohammad Anwar Hossain, Advocate Lokman Shah, and Advocate Didarul Alam Tipu were detained by Jatrabari police station.
On October 25 (Wednesday), Advocate Matiur Rahman Akand, a Bangladesh Supreme Court lawyer and leader of Jamaat E Islami Bangladesh, was arrested by the police at his residence in Uttara. He was subsequently sent to jail by ambulance due to his medical condition as he is a cardiac patient. Matiur Rahman Akand holds the position of Secretary-General of the Central Committee of the Bangladesh Lawyers Council, an organization comprised of pro-Jamaat E Islami lawyers.
On October 23, law and order forces picked up two lawyers at Narayanganj Court, Advocate Khorshed Alam Molla and Advocate Siddiqur Rahman, engaged in the legal profession in their chambers. They were kept in DB custody overnight and released the next day amid protests by other lawyers. There were no complaints or cases pending against them.
Advocate Shahanur Islam, the founder president of JusticeMakers Bangladesh in France (JMBF) and a prominent human rights lawyer, strongly condemns and protests the arrests, fabrication of cases, the picking up of lawyers from their chambers, and police attacks on the protest rally related to the grand gathering and demonstration organized by BNP-Jamaat on October 28 in Dhaka.
Advocate Shahanur Islam believes that police brutality and arbitrary arrests of lawyers for peaceful meetings and demonstrations are clear violations of the Constitution of the People's Republic of Bangladesh, the Universal Declaration of Human Rights, and various international human rights instruments to which Bangladesh is a state party.
He strongly demands that the government refrain from impeding lawyers in the exercise of their fundamental rights, such as protesting, and take effective measures against all forms of police brutality. This includes preventing any obstruction of lawyers' ability to freely and fairly participate in peaceful meetings and demonstrations while enjoying their fundamental rights.
Advocate Shahanur Islam said, "Article 37 of the Constitution of the People's Republic of Bangladesh, Article 20 of the United Nations Declaration of Human Rights, and Article 21 of the International Covenant on Civil and Political Rights provide citizens with the right to peaceful assembly, a right the government is obligated to fully respect. However, for a long time, the opposition political parties have been forcibly obstructing meetings, gatherings, marches, and meetings in the country in violation of the country's constitution and international human rights declarations and agreements, which is unacceptable."
Advocate Shahanur Islam also emphasized that Article 35(5) of the Constitution of the People's Republic of Bangladesh, Article 5 of the UDHR, Article 7 of the ICCPR, and the UNCAT explicitly prohibit all forms of torture. Despite the complete prohibition, the police have regularly engaged in the arbitrary arrest and torture of the general public, including opposition party political leaders, supporters, various professionals, and students. Consequently, the police have arbitrarily arrested lawyers affiliated with pro-BNP-Jamaat groups and have even resorted to attacking protest marches, thus violating and disregarding the Constitution and international human rights norms and principles, which should stop immediately.

পুলিশ কর্তৃক ঢাকায় মহাসমাবেশের পূর্বে, যোগদানে আসাকালে ও মহাসমাবেশ পরবর্তীতে বিএনপি জামাতপন্থি ১১ জন আইনজীবী গ্রেফতার, ফরিদপুরে মহাসমাবেশকে সমর্থন করে বিক্ষোভ মিছিলে পুলিশী হামলা ও নির্যাতন করে ৫ আইনজীবী গ্রেফতার এবং নারায়ণগঞ্জে মহাসমাবেশের আগে চেম্বার থেকে দুই আইনুজীবীকে আটক করে গোয়ান্দা অফিসে রেখে পরদিন ছেড়ে দেয়ার ঘটনা দ্রুত হাইকর্টের বিচারপতির মাধ্যমে নিরপেক্ষ তদন্তের মাধ্যমে অভিযুক্তদের চিহ্নিতপূর্বক অবিলম্বে ফৌজদারি আইনে স্বচ্ছ বিচারান্তে দৃষ্টান্তমূলক শাস্তি এবং গ্রেফতারকৃত আইনজীবীদের দ্রুত নিঃশর্ত মুক্তি প্রদানসহ তাদের বিরুদ্ধে দায়েরকৃত মামলা প্রত্যাহারের আহ্বান জানিয়েছ প্যারিস ভিত্তিক মানবাধিকার প্রতিষ্ঠান জেএমবিএফ।
বাংলাদেশে প্রকাশিত বিভিন্ন পত্রিকার অনলাইন ভার্ষণ মাধ্যমে জানা যায় যে, গত ৩০ অক্টোবর রাত ৮টার দিকে বাংলাদেশ সুপ্রীমকোর্টের আইনজীবী ও বিএনপি’র যুগ্ম মহাসচিব সৈয়দ মোয়াজ্জেম হোসেন আলালকে রাজধানীর কাঁঠালবাগান এলাকা থেকে গ্রেফতার করা হয়। গত ২৮ অক্টোবর বিএনপির মহাসমাবেশকে কেন্দ্র করে হওয়া একাধিক মামলায় তাকে আসামি করে জেল হাজতে প্রেরণ করা হয়েছে। এর আগে গত ২৯ অক্টোবর (রোববার) সকালে আলালের লালমাটিয়ার বাসায় তল্লাশি চালায় ডিবি পুলিশ। তাকে না পেয়ে বাসার প্রতিটি রুম তল্লাশি করেন তারা। এরপর দুপুর পৌনে ১২টার দিকে তার বনানীর বাসায় যায় ডিবি পুলিশ।
২৯ অক্টোবর (রোববার) সকাল সাড়ে ১০টার দিকে ফরিদপুরে বিএনপি-জামায়াতের ডাকা সকাল-সন্ধ্যা হরতালের সমর্থনে আদালত চত্বরে জাতীয়তাবাদী আইনজীবী ফোরামের মিছিলে লাঠিচার্জ করে পুলিশ পাঁচ আইনজীবীকে গ্রেফতার করে। গ্রেফতাররা হলেন-জেলা আইনজীবী ফোরামের সভাপতি অ্যাডভোকেট আলী আশরাফ নান্নু, অ্যাডভোকেট তারেক আইয়ুব খান, অ্যাডভোকেট জাহিদুল ইসলাম লাবলু, অ্যাডভোকেট খসরুল আলম ও অ্যাডভোকেট অ্যাডভোকেট নজরুল ইসলাম। হরতালের সমর্থনে সকালে আদালত চত্বরে বিক্ষোভ মিছিল বের করে জাতীয়তাবাদী আইনজীবী ফোরাম। হরতালের সমর্থনে জাতীয়তাবাদী আইনজীবী ফোরামের মিছিলটি জেলা প্রশাসকের কার্যালয়ের সামনে দিয়ে লালদীঘি পুকুর মার্কেটের সামনে দিয়ে স্বাধীনতা চত্বরের দিকে এগোতে থাকলে পুলিশ লাঠি চার্জ করে তাদের ছত্রভঙ্গ করে দেয় এবং সেখান থেকে পাঁচ আইনজীবীকে গ্রেফতার করে জেল হাজতে প্রেরণ করে।
২৭ অক্টোবর (শুক্রবার) দিবাগত রাতে রাজধানীর বিভিন্ন এলাকা থেকে সরকার পতনের এক দফা দাবিতে আয়োজিত বিএনপির মহাসমাবেশকে কেন্দ্র করে গোয়েন্দা পুলিশ ৯ জন আইনজীবীকে গ্রেফতার করে জেল হাজতে প্রেরণ করে। গ্রেফতারকৃত আইনজীবীরা হলেন, সুপ্রীম কোর্টের আইনজীবী, বাংলাদেশ জাতীয়তাবাদী আইনজীবী ফোরাম, কেন্দ্রীয় কমিটির সহ-পরিবেশ বিষয়ক সম্পাদক ও জাতীয়তাবাদী যুবদল, কেন্দ্রীয় কমিটির সহ-আইন বিষয়ক সম্পাদক অ্যাডভোকেট নূরে আলম সিদ্দিকী সোহাগ, অ্যাডভোকেট মঞ্জুরুল আলম সুজন, অ্যাডভোকেট জুয়েল মুন্সি সুমন, অ্যাডভোকেট নুরুল্লাহ, অ্যাডভোকেট সাইফুল ইসলাম এবং চট্টগ্রাম বারের তিন জন আইনজীবী অ্যাডভোকেট মোহাম্মদ আনোয়ার হোসেন, অ্যাডভোকেট লোকমান শাহ ও অ্যাডভোকেট দিদারুল আলম টিপুকে যাত্রাবাড়ি থানা পুলিশ আটক করেছে।
গত ২৫ অক্টোবর (বুধবার) উত্তরার বাসা থেকে বাংলাদেশ সুপ্রীমকোর্টের আইনজীবী ও জামায়াত নেতা অ্যাডভোকেট মতিউর রহমান আকন্দকে অসুস্থ অবস্থায় গ্রেফতার করে পুলিশ। পরে অ্যাম্বুলেন্সে করে আদালতের মাধ্যমে তাকে কারাগারে পাঠানো হয়। মতিউর রহমান আকন্দ জামায়াতপন্থি আইনজীবীদের সংগঠন বাংলাদেশ ল’ইয়ার্স কাউন্সিলের কেন্দ্রীয় কমিটির সেক্রেটারি জেনারেল হিসেবে দায়িত্ব পালন করছেন।
গত ২৩ অক্টোবর আইন-শৃঙ্খলা রক্ষাকারী বাহিনী ‘নারায়ণগঞ্জ আদালতে আইন পেশায় নিয়োজিত দুই আইনজীবী অ্যাডভোকেট খোরশেদ আলম মোল্লা ও অ্যাডভোকেট সিদ্দিকুর রহমানকে তাদের চেম্বার থেকে তুলে নিয়ে যায়। সারা রাত তাদের ডিবি হেফাজতে রেখে পরদিন দুপুরে আইনজীবীদের প্রতিবাদের মুখে ছেড়ে দেওয়া হয়। তাদের বিরুদ্ধে কোনও অভিযোগ বা মামলা চলমান নেই।
গত ২৮ অক্টোবর বিএনপি –জামাত আয়োজিত মহা সমাবেশকে কেন্দ্র করে আইনজীবীদের ১৮ জন আইনজীবীকে গ্রেফতার, নির্যাতন, মিথ্যা মামলায় জড়িত করা, আইনজীবীর চেম্বার থেকে তুলে নিয়ে সহ বিক্ষোভ মিছিলে পুলিশী হামলার ঘটনায় জাস্টিসমেকার্স বাংলাদেশ ইন ফ্রান্স (জেএমবিএফ)এর প্রতিষ্ঠাতা সভাপতি এবং বিশিষ্ট মানবাধিকার আইনজীবী অ্যাডভোকেট শাহানূর ইসলাম তীব্র নিন্দা ও প্রতিবাদ জানিয়েছেন।
পাশাপাশি আইনজীবীদের শান্তিপূর্ণ সভা সমাবেশ ও বিক্ষোভ মিছিলে অংশগ্রহণ করার মত মৌলিক অধিকার পালনে বাঁধা প্রদান না করাসহ সকল প্রকার পুলিশী নির্যাতন বদ্ধে কার্যকর ব্যবস্থা গ্রহণের জন্য সরকারের নিকট জোর দাবী জানিয়েছেন অ্যাডভোকেট শাহানূর ইসলাম ।
অ্যাডভোকেট শাহানূর ইসলাম বলেন যে, “গণপ্রজাতন্ত্রী বাংলাদেশ সংবিধানের ৩৭ অনুচ্ছেদ, জাতিসংঘ মানবাধিকার ঘোষণাপত্রের ২০ এবং আন্তর্জাতিক মানবাধিকার নাগরিক ও রাজনৈতিক অধিকার বিষয়ক আন্তর্জাতিক চুক্তির ২১ ধারা একজন নাগরিকের শান্তিপূর্ণ সভা, সমাবেশ করার অধিকার প্রদান করেছে, যা সরকারের সম্পূর্ণরূপে মান্য করার বাধ্যবাধকতা রয়েছে, কিন্তু সরকার দীর্ঘদিন যাবত দেশের সংবিধান, আন্তর্জাতিক মানবাধিকার ঘোষণপত্র ও চুক্তিসমূহ লংঘন করে বিরোধী রাজনৈতিক দলসমূহের সভা সমাবেশ মিছিল মিটিং এ বলপূর্বক বাঁধা প্রদান করে আসছে, যা কোনভাবেই কাম্য নয়”।
অ্যাডভোকেট শাহানূর ইসলাম আরো বলেন যে, গণপ্রজাতন্ত্রী বাংলাদেশ সংবিধানের ৩৫(৫)অনুচ্ছেদ,অনুচ্ছেদ, জাতিসংঘ মানবাধিকার ঘোষণাপত্রের ৫ এবং আন্তর্জাতিক মানবাধিকার নাগরিক ও রাজনৈতিক অধিকার বিষয়ক আন্তর্জাতিক চুক্তির ৭ ধারায় এবং নির্যাতন এবং অন্যান্য নিষ্ঠুর, অমানবিক ও লাঞ্ছনাকর ব্যবহারের বিরুদ্ধে আন্তর্জাতিক সনদে সকল প্রকার নির্যাতনকে সম্পূর্ণরূপে নিশিদ্ধ করা হলেও পুলিশ নিয়মিত বিরোধী দলীয় রাজনৈতিক নেতাকর্মী, সমর্থক, বিভিন্ন পেশাজীবী ও ছাত্রসহ সাধারণ জনগণকে গ্রেফতার ও নির্যাতন করে আসছে। যার ধারাবাহিকতায় দেশের সর্বোচ্চ আইন সংবিধান, মানবাধিকার ঘোষণাপত্র সহ অন্যনান্য মানবাবাধিকার চুক্তি ও সনদসমূহ লঙ্ঘন ও অবজ্ঞা করে পুলিশ বিএনপি-জামাত পন্থী আইনজীবীদের নির্বিচারে গ্রেফতার ও বিক্ষোভ মিছিলে হামলা চালিয়েছে, যা এখনি বন্ধ হওয়া উচিত।
